Small victory for consumers over bank charges – but no payout expected

The man on the street won a small victory over the UK’s biggest banks after the High Court ruled that high overdraft fees may be declared unfair.

The court case was prompted by hundreds of thousands of bank customers who have tried since 2006 to reclaim their overdraft charges on the grounds that they were too high, and as a result, unfair.

Despite the victory, the judge warned that claimants should not expect an automatic pay-out, as the case may be delayed by more hearings. However, the decision paves the way for a further hearing in which the court will decide whether the charges are unfair and, if so, what a fair charge should be.
